New York State Subpoenas Intel Over Antitrust Issues

Those of you who follow the legal wranglings of Intel may already know that the mega chipmaker is under investigation in a myriad of countries for possible anticompetitive practices.

Rival AMD has filed civil lawsuits and a myriad of other legal complaints against Intel in the European Union, Japan, and South Korea.

AMD alleges that because Intel controls about 90 percent of the marketshare — which as of the last couple years, includes Macs, too — that Intel has been manipulating the market. While the Feds have been reluctant to get involved, this is the second case that Intel has had to face here at home. In 2005, AMD filed a civil case in federal court in Delaware, which is still pending.

The New York Times reports that while Intel is denying any wrongdoing, it acknowledges that it will comply with the investigation.

NYT:

The New York subpoenas will seek internal memorandums, billing documents and correspondence between Intel and its customers to determine whether the company engaged in anticompetitive practices — like penalizing customers, primarily computer manufacturers — for buying processors from competitors or improperly paying customers to use Intel chips exclusively.

“Protecting fair and open competition in the microprocessor market is critical to New York, the United States and the world,” [Attorney General Andrew] Cuomo said Thursday in a statement. “Monopolistic practices are a serious concern, particularly for New Yorkers who are navigating an information-intensive economy.”
